When you capitalize a cost, you add it to the basis of property to which it relates. You can deduct any tax imposed by a state or local government on personal property used in your trade or business. Generally, you can deduct as a business expense all excise taxes that are ordinary and necessary expenses of carrying on your trade or business. Your deduction for wages paid is not reduced by the social security and Medicare taxes, Additional Medicare Tax, and income taxes you withhold from your employees. You can deduct the employment taxes you must pay from your own funds as taxes. Generally, you can take either a deduction or a credit for income taxes imposed on you by a foreign country or a U.S. possession, subject to limitations.
This rule applies to contracts issued after June 8, 1997, that cover someone other than an officer, director, employee, or 20% owner. If the policy or contract covers a key person, you can deduct the interest on up to $50,000 of debt for that person. If you qualify, you can use the nonaccrual-experience method of accounting, discussed later. Under this method, you don’t have to accrue income that, based on your experience, you don’t expect to collect. A bad debt is either a business bad debt or a nonbusiness bad debt. You may revoke an election to treat the cutting of timber as a sale or exchange, without the IRS’s consent, by the due date (including extensions) for the return.
In some cases, you may not be allowed to deduct the expense at all. Therefore, it is important to distinguish usual business expenses from expenses that include the following. The data in the preceding table clearly shows that there is statistical significance.
